The Rules and Regulations of the bpower2.com website

Introduction – Article 1

These Rules and Regulations have been drawn up on the basis of legal regulations in force on the territory of the
Republic of Poland, and the subject of its regulation are the conditions of use and functioning of the bpower2.com
website available at the internet address bpower2.com. The Rules and Regulations define the rights and
obligations of Website Users, as well as the rights, obligations and scope of responsibility of the Administrator of
the Website. Each potential User at the moment of registration is obliged to familiarize themselves with the
content of the Rules and Regulations, and then may take further actions after prior consent and acceptance of all its provisions.

Definitions – Article 2

The terms used in the Rules and Regulations mean respectively:

2.1. The Rules and Regulations of the Website mean these Rules and Regulations which regulate the rights and
obligations of Users and the Administrator of the Website. The Rules and Regulations constitute this document
and appendixes being an integral part of hereof.
2.2. Website means the information portal available at the internet address bpower2.com, being an internet
platform and enabling Users to use the Bpower2 system, which is a website supporting organization
management, information processing, filling, submitting and archiving of electronic documents.
2.3. Website Administrator — an entity providing the service of making the Website resources available to Users,
which is Bpower2 LTD, Caraven House 40-44 Uxbridge Road, London, United Kingdom.
2.4. Bpower2 User Account Database means a set of data provided by Users, which are collected with their
consent, processed in an orderly manner in an IT system, for the needs of services provided by the Website
Administrator and for the needs of the Bpower2 Website.
2.5. Account means a space available for the User on the Website, through which he/she enters and manages
data. The account contains data voluntarily made available by the User on the Website, which can be used by the
Website Administrator under the conditions specified in these Rules and Regulations as well as their appendixes.
2.6. Person means any natural or legal person, or any association not having legal personality, to which legal
capacity is conferred by law.
2.7. Mail means an electronic mailbox used for communication between Users.
2.8. The User means an adult natural person with full legal capacity who, through acceptance of the Rules and
Regulations and registration, has gained access to the services offered by the Bpower2 Website. The User may
also be a minor person and/or a person without full legal capacity, provided that the consent of the statutory
representative is obtained. In order to be able to take full advantage of the services offered by the Website, the
User must register an Account.

Technical terms and conditions of using the Website – Article 3

3.1 The owner of the Website is Bpower2 LTD, Caraven House 40-44 Uxbridge Road, London, United Kingdom.
3.2 In order to use the Websites correctly, the User should meet the following conditions: have a PC, tablet,
mobile phone or smartphone, equipped with a network card or modem enabling access to the Internet, have a
web browser supporting encrypted SSL connections, JavaScript application and cookies in the latest version,
have an Internet connection.
3.3 The name of the Website, its concept, graphic design, software and database are subject to legal protection.

Terms and conditions of using the Website – Article

4.1 Users of the Website are its Users.

4.2 Creating and using the Website Account is voluntary and free of charge.

4.3 Paid services are provided by the Website Administrator to Users after placing an order and paying the fee
specified in Appendix No 2.
4.4 The registration procedure and the creation of an Account is carried out by filling in the registration form
available at the bpower2.com website or after prior arrangements by the Website Administrator. The contract for
the provision of services by electronic means is concluded at the moment of registration, for an indefinite period of
time.
4.5 Account User undertakes to provide truthful data in the registration form.
4.6 Acceptance of the Rules and Regulations by the Account User is tantamount to making statements of the
following contents:
a. I have read the Rules and Regulations of the Website and accept all their provisions together with their
appendixes,
I have started to use Bpower2 website voluntarily,
c. The data contained in the registration form and in the Account are true,
d. I hereby agree to the processing of my personal data by the Website Administrator, provided in the registration
form and given to the Website Administrator for the purposes of the proper performance of the contract for the
provision of services by electronic means,
e. I hereby agree to the processing of data contained in the registration form and given to the Website
Administrator for marketing and promotional purposes, and in particular to the receipt of marketing and
advertising materials. This information can be sent in any form specified by the Website Administrator using my
data in the possession of the Website Administrator,
f. I hereby agree to receive system information, messages from the Website Administrator and information about
difficulties, changes or technical interruptions in the operation of the Website,
g. Placing personal data and information concerning other persons on the Account was done in a legal manner,
voluntarily and with their consent.

Privacy Policy – Article 5

5.1 During the registration process, the User agrees to have his/her personal data stored and processed by the
Website Administrator, in accordance with the conditions specified in the Website Privacy Policy (Appendix No 1).
5.2 The Administrator of the Personal Data is Bpower2 LTD, Caraven House 40-44 Uxbridge Road, London,
United Kingdom, who processes Users' personal data in accordance with the provisions of the Act of 29 August
1997 on Personal Data Protection (Journal of Laws of 2002, No. 101, item 926, as amended) and the Act of 18
July 2002 on Providing Services by Electronic Means (Journal of Laws No. 144, item 1204, as amended).
5.3 The data contained in the registration form and provided to the Website Administrator are used by the
Website Administrator to conclude, amend, terminate and ensure the highest quality of services provided by
Bpower2 within the scope of the Rules and Regulations of the Website.
5.4 The User has the right to access the processed data at any time, as well as the right to correct them and
demand their removal from the Bpower2 User Accounts Database.
5.5 The user is obliged to update the data provided in the registration form and the user profile immediately after
each change of this data.
5.6 In case when the Website Administrator has any doubts as to the accuracy or validity of the data provided by
the User in the registration form, the Administrator may take the following actions:

a. Call upon the User to immediately remove false data or update data,
b. Block the User Account until the matter is clarified.
5.7 The Website Administrator is entitled to disclose personal data only to entities authorized on the basis of
relevant legal regulations, in accordance with the principles of Bpower2 Website Privacy Policy, provisions of
these Rules and Regulations and applicable legal regulations.

Terms and conditions of using the Website – Article 6

6.1 Actions that may hinder or destabilize the operation of the Website are unacceptable. In the event of such
actions being committed by the User, the Website Administrator has the right to immediately block the User's
Account. User's actions consisting in an attempt to destabilize the Website are prohibited under the law in force.
The Website Administrator may then take appropriate actions, including those aimed at compensating for the
damage suffered by the Website Administrator.
6.2 By concluding the contract with the Website Administrator, the User undertakes in particular to:
a. Comply with the proprietary copyrights and rights resulting from registration of inventions, patents, trademarks,
utility and industrial designs of the Website Administrator and other persons,
b. Refrain from any actions that would violate the privacy of other Users, primarily consisting in the collection,
processing and dissemination of information about other Users without their express consent, except when these
actions are in accordance with the law and the provisions of these Regulations,
c. Refrain from any activities that could hinder or interfere with the functioning of the Website, as well as activities
consisting in destroying, changing, removing, damaging, hindering access to the Accounts of other Users,
d. Not to take any action to the detriment of the Website Administrator, Users and other Persons.
6.3 The User declares that all content and personal data published by him/her on the Website are true and do not
violate any copyright and personal rights. The User also declares that he has obtained the consent of other
persons to publish content concerning or presenting such persons.
6.4 User, by publishing data and other content on the Account, agrees to review this information by the Website
Administrator and also authorizes the Website Administrator to use them in accordance with Article 4.6 of the
Rules and Regulations. In the case of publishing on the Website content having the character of a work within the
meaning of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2006, No. 90, item
631, as amended), the User grants the Website Administrator a free-of-charge, non-exclusive licence to use the
data made available for the purposes of providing services in the Bpower2 Website, and waives all claims against
the Website Administrator in the event of their use, including copying for purposes related to the activities of the
Bpower2 Website.
6.5 It is forbidden to use the Website in a manner contrary to or inappropriate to its purpose.

Liability – Article 7

7.1 The Website Administrator is obliged to ensure the highest quality of services. The Website Administrator is
not liable for disruptions in the functioning of the Bpower2 Website caused by force majeure, equipment failure or
unauthorized interference of Users, even in the case which would cause loss of data on Users' Accounts.
7.2 The Website Administrator is not liable for temporary inability of Users to use certain functions of the Website,
resulting from changes and improvements in the system. Users will be notified of technical interruptions and their
duration.
7.3 The Website Administrator is not liable for the content provided by Users. Content provided by Users are not
views and opinions of the creators of the Website. The Website Administrator reserves the right to edit, shorten
texts or remove content prohibited by law, vulgar, offensive or otherwise violating the rules of social coexistence.
The User submitting prohibited content may be subject to criminal and civil liability towards the Website
Administrator or other Persons.

7.4 The Website Administrator is not liable for the actions of other Persons, nor for their use of User data contrary
to the purpose of the Website.

Complaints Policy – Article 8

8.1 The User may complain about any disturbances in the functioning of the Website by reporting them to the
Website Administrator.
8.2 Complaints are considered by the Website Administrator within 14 days from the date of complaint. The
Website Administrator reserves the right to leave a complaint unanswered if it results from unfamiliarity with the
provisions of these Rules and Regulations or the law.
8.3 The Website Administrator reserves the right to interfere in the User Account in order to remove errors in the
functioning of the Website and disturbances or problems in the functioning of the Account.
8.4 The Website Administrator may not consider complaints about services provided by other persons using the
Website functions. The Website Administrator is also not obliged to pass the complaint to the entity competent to
handle the complaint.

Final provisions – Article 9

9.1 The latest version of the Rules and Regulations is available at bpower2.com.
9.2 The Website Administrator reserves the right to unilaterally change the provisions of the Rules and
Regulations at any time and without the need to justify the reason.
9.3 In case of any changes in the Rules and Regulations, the Website Administrator informs the Users about it
immediately by publishing the uniform text of the Rules and Regulations on the sites of the Website specified in
Article 9.1.
9.4 If any changes have been made to the Rules and Regulations, the condition for further use of the Website is
to accept the Rules and Regulations in their entirety as amended. After reading the new content of the Rules and
Regulations, the User declares the following: I declare that I have read the new content of the Rules and
Regulations and accept all its provisions. By submitting the statement, the User agrees to continue the contract
with the Website Administrator. In case of lack of acceptance of the changes in the Rules and Regulations, the
User terminates the contract with the Website Administrator, which is tantamount to deleting the Account.
9.5 The Rules and Regulations enter into force on the day of announcement on the site of the Website. Contracts
concluded between Users and the Website Administrator before the date of entry into force of the Rules and
Regulations are subject to its provisions at the moment of acceptance of the Rules and Regulations by the User.
9.6 In the event of a change or annulment, as a result of a final court ruling, of any of the provisions of these
Rules and Regulations, the remaining provisions remain in force and are binding on the parties.
